RCFE/ARF Continuing Education Irvine June 2015

Eldercare Training Academy has scheduled two days of continuing education classes for RCFE/ARF CEU’s at Atria Woodbridge in Irvine Friday June 26th and Saturday June 27th 2015.

Friday  June 26th  Barbara Colter will provide training on issues related workplace safety; Cal OSHA requirements for residential care facilities including, infection control and prevention, fire safety, emergency action and first aid plan, ergonomics and fall prevention.  Barbara will also address staff training for facility maintenance to comply with Title 22 regulations.

Saturday, June 27th Laura and Michael Ferrall will provide students with comprehensive information on newly passed legislation that will impact both ARF and RCFE facilities.  Laura will provide students with sample documents to comply with the new legislation.  The course will include important information regarding hospice care for facilities to stay in compliance.

RCFE Liability Insurance Compliance Chart

California Paid Sick Leave – Commences on July 1 2015

An employee who, on or after July 1, 2015, works in California for 30 or more days within a year from the beginning of employment, is entitled to paid sick leave.

Employees, including part-time and temporary employees, will earn at least one hour of paid leave for every 30 hours worked. Accrual begins on the first day of employment or July 1, 2015, whichever is later.   Employers are required to notify employees and display poster on Paid Sick Leave  as well.

CCLD Enforcement for Required RCFE Liability Insurance

Community Care Licensing has begun to enforce RCFE facility compliance with Liability Insurance which includes the following:

Proof of Liability Insurance Requirements

  • All RCFE facilities shall maintain proof of liability insurance at the facility.  (Declaration page of certificate of insurance)
  • All RCFE facilities shall submit to their LPA proof of liability insurance (newly obtained, renewed or revised policy)
  • New facility applicants shall submit proof of insurance within 60 days of licensure

LPA facility visits  (routine or complaint)

  • LPA will cite licensee who do not provide proof of insurance at time of site visit
  • Citation is considered either type B or C depending on the level of risk the violation represents
  • Civil penalties shall be assessed when the licensee fails to correct the violation
  • If cited for non-compliance, the facility will have 30 days to correct

Suspension of Resident Admissions by CCLD SB1153

SB 1153

This bill authorizes the Department to suspend new admissions for licensees that violate statute and/or regulation which presents a direct or immediate risk to the health, safety or personal rights of residents. The Department can also suspend new admissions for licensees failing to pay fines assessed by the Department. The order of suspension of new admissions will be stayed during the appeal process.

2016 RCFE Administrator and Staff Training requirements

AB 1570

Increases both the RCFE administrator and  direct staff training hours and subjects covered in the training. The bill also enhances the administrator certification process specific to the exam, core of knowledge and training methods.

SB 911

Increases training hour and topic requirements for RCFE administrators and direct care staff.  Prohibits RCFEs from discriminating or retaliating against a resident, employee, or other person for contacting 911. Requires licensees providing care to residents with prohibited or restricted health conditions to ensure that care is provided by specified professionals under specified conditions.

2016 Initial RCFE Administrator Training

  • 80 hours of total hours for initial RCFE Administrator Training
  • 60 of the 80 hours in the classroom
  • 20 more hours can be classroom or online
  • 100 questions on the exam

Administrator Recertification

  • Of the 40 Continuing Education Units (CEUs) required to renew (or 20 for  RCFE/NHA administrators), administrators must complete at least four (4) hours in laws, regulations, policies and procedural standards for their facility type, and if not included in their initial administrator training, at least (1) hour in cultural competency and sensitivity to the lesbian, gay, bisexual and transgender community.
  • Only CEU courses approved by CDSS (or Regional Centers where applicable for GH and ARF administrators) will be accepted toward fulfilling CEU requirements
  • Recertification applications cannot be submitted more than 90 days before certification expiration

RCFE/ARF Administrator Training Requirements 2016

Administrator Recertification

  • Of the 40 Continuing Education Units (CEUs) required to renew (or 20 for  RCFE/NHA administrators), administrators must complete:
    • At least four (4) hours in laws, regulations, policies and procedural standards for their facility type, and if not included in their initial administrator training,
    •  At least (1) hour in cultural competency and sensitivity to the lesbian, gay, bisexual and transgender community.  RCFE Administrator must complete
    • At least eight (8) hours (RCFE only) in the subject related to serving residents with Alzheimer’s disease and other dementias, including, but not limited to instruction related to direct care, physical environment and admissions procedures and assessments.
  • Only CEU courses approved by CDSS (or Regional Centers where applicable for GH and ARF administrators) will be accepted toward fulfilling CEU requirements
  • Recertification applications cannot be submitted more than 90 days before certification expiration
  • LIC9214 is the new Administrator Certification application form to be submitted for renewal to CCLD.
